Welcome to QuillScape. These Terms of Service (“Terms”) govern your access to and use of QuillScape (“Service”, “Platform”, “we”, “us”, or “our”), a web-based writing application for novelists and authors, operated by Salvatore Patti.
By accessing or using QuillScape, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Description of Service
QuillScape is a product/brand operated by Salvatore Patti
QuillScape is a Software-as-a-Service (SaaS) platform designed for writers, novelists, and editors. The Service provides tools for organizing writing projects, including chapter management, character sheets, location tracking with maps, visual timelines, real-time collaboration, AI-assisted writing features, and document export functionality.
2. Account Registration
To use certain features of the Service, you must create an account. When registering, you agree to:
Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your password and account
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use of your account
3. Subscription Plans and Payments
3.1 Available Plans
QuillScape offers a free plan with limited features and paid subscription plans (Writer and Pro) with enhanced functionality. Details of each plan, including features and pricing, are available on our website at quillscape.eu.
3.2 Payment Processing
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
When you purchase a subscription, you are purchasing from Paddle.com, who will process your payment and handle billing-related inquiries. Paddle will charge your chosen payment method for any paid subscriptions, including applicable taxes.
3.3 Automatic Renewal
Paid subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You will receive email notification before each renewal.
3.4 Cancellation
You may cancel your subscription at any time through your account settings. After cancellation, you will retain access to paid features until the end of your current billing period. No pro-rata refunds are provided for unused time.
4. User Content
4.1 Ownership
You retain all ownership rights to the content you create, upload, or store on QuillScape (“User Content”). QuillScape does not claim any ownership over your manuscripts, notes, character sheets, or any other creative work.
4.2 License to QuillScape
By using the Service, you grant QuillScape a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service to you. This license terminates when you delete your content or account.
4.3 Responsibility
You are solely responsible for your User Content. You represent that you have all necessary rights to upload and use such content, and that your content does not violate any third-party rights or applicable laws.
5. Acceptable Use
You agree not to use the Service to:
Violate any applicable laws or regulations
Infringe upon the intellectual property rights of others
Upload or transmit malware, viruses, or harmful code
Attempt to gain unauthorized access to the Service or other users’ accounts
Interfere with or disrupt the integrity or performance of the Service
Use the Service to harass, abuse, or harm others
Use automated systems to access the Service without permission
6. AI Features
QuillScape integrates third-party AI services (including OpenAI, Google Gemini, and Anthropic Claude) to provide writing assistance features. These features are provided “as-is” and may be subject to the terms and conditions of the respective AI providers. AI-generated content is provided as a tool to assist your writing, not to replace your creative work.
You may use your own API keys for AI services. In such cases, you are responsible for compliance with the respective provider’s terms of service and any associated costs.
7. Intellectual Property
The Service, including its original content, features, and functionality (excluding User Content), is owned by Salvatore Patti and is protected by international copyright, trademark, and other intellectual property laws. The QuillScape name, logo, and all related marks are trademarks of Salvatore Patti.
8. Privacy
Your privacy is important to us. Please review our Privacy Policy at quillscape.eu/privacy-policy to understand how we collect, use, and protect your personal information.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUILLSCAPE AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless QuillScape, Salvatore Patti, and any affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
12. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Upon termination, your right to use the Service will immediately cease. You may export your User Content before termination. We are not obligated to retain your data after account termination.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Catania, Italy.
